Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes prohibited uses of the Howdy Dispatch Service and is incorporated by reference into our Terms of Service. We can suspend or terminate any account that violates this AUP.

Prohibited uses

You may not use the Service to:

  • Violate law or regulation, including FMCSA rules, hours-of-service requirements, hazmat regulations, controlled-substances laws, and state employment-monitoring laws applicable to your drivers;
  • Misuse Driver GPS data for stalking, harassment, retaliation against drivers exercising labor rights, or any purpose unrelated to legitimate dispatching operations. Driver GPS data is collected for assignment visibility, not surveillance.
  • Reverse-engineer or scrape the Service, decompile its applications, or extract its underlying data, except as expressly allowed by applicable law;
  • Submit malicious content, including malware, exploit code, scripts intended to disrupt the Service or harm other Carriers, or attempts to bypass authentication, authorization, or billing controls;
  • Resell, sublicense, or white-label the Service to non-Authorized Users, except via our Enterprise tier with a written agreement;
  • Misrepresent identity, including impersonating another Carrier, falsifying MC#, USDOT#, or operating authority status, or creating accounts under fake personas;
  • Send unsolicited communications using the Service's email, notification, or messaging features;
  • Use the Service for any illegal cargo, including controlled substances, stolen property, contraband, untaxed regulated goods, or freight where the operator lacks lawful authority to transport;
  • Falsify load or delivery records, including manipulating photos, GPS coordinates, timestamps, or signed-proof documents;
  • Circumvent technical limits, including rate limits, multi-tenant isolation, seat caps, billing meters, or any other restriction.

Driver privacy boundaries

Carriers and dispatchers must not use the GPS-tracking functionality of the Service to harass, intimidate, surveil, or retaliate against drivers. GPS data is a legitimate operational signal for assignment visibility. It is not a substitute for management. The Carrier is responsible for ensuring its drivers receive any notice or consent required by applicable state law.

If you believe a Carrier or user is violating this AUP, contact us at hello@howdydispatch.comwith the subject line "AUP Report" and details we can investigate.

Enforcement

We can suspend or terminate any account that violates this AUP, with or without prior notice. We will work in good faith to address violations through the least disruptive remedy that protects other Carriers, regulators, and the public.
